Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of chargedplumbing.ca (the "Site"), operated by Elevate Service Group Plumbing ("Elevate Service Group Plumbing", "we", "us", or "our").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Definitions
"Content" means all text, images, graphics, logos, video, layout, code and other material available on the Site.
"Service" means the Site and any functionality made available through it, including quote request forms.
"User", "you" and "your" mean any person who accesses or uses the Site.
"Work" means plumbing, hydronic heating, water treatment or maintenance services performed by Elevate Service Group Plumbing under a separate agreement.
2. Changes to These Terms
We may revise these Terms at any time. The revised version takes effect when posted to this page, and the effective date above will be updated. Your continued use of the Site after changes are posted means you accept the revised Terms. Please review this page periodically.
3. What This Site Is, and What It Is Not
The Site is an informational and marketing resource. It describes the services we offer and the areas we serve, and it allows you to request a quote or contact us.
The Site does not provide plumbing, heating or safety advice for your specific situation. Articles, checklists, service descriptions and other Content are general information only. Plumbing and hydronic heating systems vary, and work performed incorrectly can cause serious injury, flooding, property damage, or health hazards from unsafe water quality.
You must not rely on Content on this Site as a substitute for assessment by a licensed contractor. In Ontario, most plumbing work must be performed in accordance with the Ontario Building Code and applicable municipal permitting and inspection requirements, and certain work (such as backflow prevention testing) may require certified testing and reporting to the local authority. Do not attempt work described on this Site yourself.

4. Quotes, Service Requests and Work
Submitting a quote request form, calling us, or emailing us does not create a contract for Work and does not guarantee that we will accept the project or attend at a given time.
Any quote or estimate we provide is subject to site inspection and may change if conditions differ from those described to us. Work is governed by the separate written quote, work order or service agreement we provide to you, not by these Terms. Where there is a conflict between these Terms and a signed agreement covering Work, that agreement governs.
Response times, including references to 24/7 emergency service, describe our general operating practice. They are not guarantees, and they may be affected by weather, road conditions, technician availability, and emergency call volume.
5. Conditions of Use
You agree not to use the Site to:
Violate any applicable federal, provincial, municipal or international law or regulation
Post or transmit content that is unlawful, defamatory, harassing, threatening, obscene, or that infringes the rights of others
Infringe any patent, trademark, trade secret, copyright or other intellectual property right
Impersonate any person or entity, or misrepresent your affiliation with a person or entity
Introduce viruses, malware, or any other malicious or technologically harmful material
Attempt to gain unauthorized access to the Site, the server on which it is stored, or any connected database or system
Interfere with or disrupt the Site, its security features, or its normal operation
Use automated systems to scrape, harvest or collect information from the Site without our prior written consent
Use the Site for any purpose that is unlawful or prohibited by these Terms
We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe breaches these Terms or is otherwise harmful.
6. Intellectual Property
The Site and all Content are owned by Elevate Service Group Plumbing or its licensors and are protected by Canadian and international copyright, trademark and other intellectual property laws.
You may view, download and print Content for your own personal, non-commercial reference in connection with considering or receiving our services. You may not otherwise reproduce, republish, distribute, modify, sell, or create derivative works from any Content without our prior written permission.
The Elevate Service Group Plumbing name, logo, and all related names and marks are trademarks of Elevate Service Group Inc. or its affiliates. You may not use them without our prior written permission.
7. Electronic Communications
By providing your email address or phone number, you consent to receive communications from us electronically in connection with your enquiry or the Work. You agree that all agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Commercial electronic messages are sent in accordance with Canada's Anti-Spam Legislation (CASL). You may withdraw consent to receive marketing messages at any time using the unsubscribe link in any marketing email, or by contacting us.
8. Reviews, Testimonials and Submissions
If you submit a review, testimonial, photograph, comment or other material to us or about us ("Submission"), you grant Elevate Service Group Plumbing a non-exclusive, royalty-free, perpetual, irrevocable and worldwide licence to use, reproduce, adapt, publish and display that Submission in connection with our business, in any media.
You represent that any Submission is your own, is accurate, and does not infringe the rights of any third party. We may remove or decline to publish any Submission at our discretion.
Testimonials displayed on the Site reflect the experience of individual customers. They are not a guarantee that you will experience the same result.
9. Third-Party Links
The Site may contain links to third-party websites, including social media platforms and the website of Elevate Service Group Inc. These links are provided for convenience only. We do not control and are not responsible for the content, accuracy, products, services or privacy practices of any third-party site. Accessing a linked site is at your own risk.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, share and protect personal information. By using the Site, you consent to the practices described in that policy.
11. Disclaimer of Warranties
The Site and all Content are provided "as is" and "as available", without warranty of any kind, express or implied.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure or error free, that defects will be corrected, or that Content is accurate, complete or current. Pricing, availability, service areas and service descriptions may change without notice.
This section applies to the Site only. It does not limit or disclaim any warranty we provide on Work performed, which is set out in the applicable written agreement, and it does not affect any statutory rights or warranties that cannot be excluded under Ontario or Canadian law.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Elevate Service Group Plumbing, its directors, officers, employees, affiliates and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profits, revenue, data, business interruption or goodwill, arising out of or in connection with your access to or use of, or inability to use, the Site or its Content, whether based in contract, tort, negligence, strict liability or otherwise, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
This section applies to your use of the Site. Liability in connection with Work performed is addressed in the applicable written agreement.
13. Indemnification
You agree to indemnify, defend and hold harmless Elevate Service Group Plumbing, its affiliates, and their respective directors, officers, employees and agents from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or connected with your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of law principles.
You agree that the courts of the Province of Ontario have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, and you attorn to the jurisdiction of those courts.
15. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elevate Service Group Plumbing regarding your use of the Site, and supersede any prior agreements or communications on that subject.
For clarity, these Terms do not supersede any written quote, work order or service agreement between you and Elevate Service Group Plumbing relating to Work.
